[value] => Der spanische Oberste Gerichtshof hat am 17. Oktober 2017 über folgende schon häufiger diskutierte Frage entschieden: Sind die im Gesetz 3/2004 vom 29. Dezember zur Bekämpfung von Zahlungsverzug im Geschäftsverkehr vorgesehenen Verzugszinsen auch im Falle von durch Anwälte erbrachte Rechtsdienstleistungen anwendbar?
Das erwähnte Gesetz, einschließlich seiner verschiedenen Novellierungen, soll ein hilfreiches Instrument für Unternehmen sein zur Eintreibung von Forderungen gegenüber von anderen Unternehmen oder Wirtschaftsteilnehmern. In diesem Sinne sind die Verzugszinsen, die dieses Gesetz festlegt, höher als der gesetzliche Zinssatz. So beträgt der Zinssatz für Verzugszinsen im Geschäftsverkehr, z.B. im laufenden Halbjahr 8 %, während der gesetzliche Zinssatz 3 % beträgt.
Umstritten war, ob die Rechtsberatung – also die von einem Rechtsanwalt erbrachte Beratungsdienstleistung – unter den Begriff „Geschäftsverkehr“ im Sinne des o.e. Gesetzes fällt. Der Rekurskläger vertrat die Meinung, die Rechtsberatung sei eine berufliche Tätigkeit und gehöre nicht zum Geschäftsverkehr zwischen Unternehmen, wie teilweise von Instanzgerichten entschieden.
Der Oberste Gerichtshof hat den Rekurs jedoch abgelehnt und festgestellt, dass – soweit der Empfänger der Rechtsdienstleistung kein Endverbraucher ist –, der Begriff „Geschäftsverkehr“ auch Dienstleistungen umfaßt, einschließlich Rechtsdienstleistungen. Der Oberste Gerichtshof gründet seine Entscheidung sowohl auf das erwähnte Gesetz 3/2004 als auch auf die verschiedenen EU-Richtlinien, die in dieser Materie ergangen sind.
Ein weiterer Grund also, die Zahlung der Rechnung ihres Rechtsanwaltes nicht – übermäßig – hinauszuzögern.

[value] => En su reciente Sentencia, de fecha 17 de octubre de 2017, el Tribunal Supremo aborda una cuestión que había sido objeto de cierta discusión: Si los intereses de demora previstos en la Ley 3/2004, de 29 de diciembre, de medidas de lucha contra la morosidad en operaciones comerciales, resultaban también de aplicación a la prestación de servicios jurídicos realizada por abogados.
La citada Ley, y sus sucesivas reformas, pretenden ser una herramienta útil para las empresas de cara a recuperar las cantidades que les adeuden otras empresas u operadores jurídicos en el marco de su actividad comercial. Así, entre otras medidas, establece unos intereses de demora sustancialmente más elevados que el interés legal del dinero. Para el presente semestre, por ejemplo, se han fijado en el 8,00%, mientras que el tipo de interés legal del dinero es del 3,00%.
Se había cuestionado si la prestación de servicios jurídicos – la labor de asesoramiento por un abogado – debía entenderse incluida en el concepto de “operaciones comerciales” al que hace referencia la Ley. En síntesis, la parte recurrente defendía que los servicios jurídicos debían considerarse como actividad profesional, y no como operación comercial entre empresas, argumento que había sido recogido por una parte de la jurisprudencia menor.
El TS, sin embargo, desestima el recurso y entiende que – siempre que el destinatario de los servicios jurídicos no sea un consumidor final – que el concepto de “operaciones comerciales” comprende también la prestación de servicios, incluidos también, evidentemente, los servicios jurídicos. El TS fundamenta su razonamiento tanto en el contenido de la Ley nacional como en la regulación de las diferentes Directivas de la Unión Europea que han sido dictadas en la materia.
He aquí, por tanto, una razón más para no demorar – en exceso – el abono de la minuta de su abogado.
