[value] => Es ist eine Tatsache, dass die Kriminalität sich mit den neuen Technologien verändert hat. Aktuell beschäftigen die sogenannten „telematischen Delikte“ Polizei und Richter immer stärker.
Das dabei häufigste Delikt ist der Betrug (ca. 80%); ein Straftatbestand mit vielzähligen Begehungsmöglichkeiten. Dazu gehören zum Beispiel der Diebstahl von Bankdaten, der Betrug bei Online-Glücksspielen sowie Kaufverträge oder andere Vertragsschlüsse ohne Einverständnis. Und auch bei anderen Straftaten lässt sich ein Anstieg beobachten, wie beispielsweise beim Ausspähen von Geheimnissen durch nicht autorisierte Nutzung von E-Mail-Konten oder durch Identitätsdiebstahl in Netzwerken, und – was Regierung und Unternehmen die größten Sorgen bereitet – bei der Beschädigung und Sabotage von IT-Systemen. Ebenfalls ist die Zahl von Beleidigungen, Bedrohungen und Nötigungen angestiegen, da die Verwendung von Netzwerken es erlaubt, verletzende Kommentare auf die virtuelle Welt loszulassen, die das Ziel haben, öffentlich zu demütigen, zu bedrohen und zu verleumden. Es überrascht, dass die Urheber dieser Vergehen in vielen Fällen junge Personen sind.
Wie selbst die Polizei eingestanden hat, wird es schwierig, die Anzahl dieser Straftaten zu senken, da der Kampf gegen die Cyberkriminalität einer Vielzahl von Hindernissen begegnet. Erstens wird der Großteil dieser Straftaten vom Ausland aus begangen und zweitens muss – selbst wenn die IP-Adresse bestimmt werden kann, von der aus ein Angriff ausgegangen ist – die konkrete Person, die den Computer zum Zeitpunkt der Tatbegehung bedient hat, identifiziert werden. Unbeschadet des Vorstehenden sollten wir jedoch auch auf die Weiterbildung der Internetnutzer über die vorhandenen Risiken setzen, um die Schäden aus dieser Art von Delikten zu vermeiden.

[value] => Es una realidad que el ámbito de la delincuencia ha cambiado con las nuevas tecnologías. Son los delitos conocidos como telemáticos los que actualmente tienen ocupados cada vez más a la Policía y a los jueces.
El delito más común es la estafa (aprox 80%), con multitud de modalidades. Por ejemplo, el robo de datos bancarios, el fraude en el juego online y ventas y contrataciones de servicios telefónicos sin consentimiento. El incremento también se ha observado en otros delitos como el de revelación de secretos a través del uso no autorizado de cuentas de correo, suplantaciones de identidad en redes o el delito que más preocupa a gobiernos y empresas, el de daños y sabotaje informático. También los delitos de injurias, amenazas y coacciones han aumentado, pues el uso de las redes permite lanzar al mundo virtual comentarios ofensivos con el fin de humillar, amenazar y desprestigiar públicamente. Sorprende que los autores de estos delitos en muchas ocasiones sean personas jóvenes.
Como la propia policía ha reconocido, resulta complicado que la comisión de estos delitos se reduzca, pues la lucha contra el cibercrimen tiene multitud de dificultades. Primero, porque la mayoría de los delitos se cometen desde el extranjero y segundo, porque incluso aunque pueda identificarse la IP desde la que se realizó un ataque habría que identificar a la persona que manejaba el equipo cuando el delito se cometió. Sin perjuicio de lo anterior, hay que confiar también en la educación de los usuarios de internet sobre los riesgos existentes para evitar los daños ocasionados por este tipo de delitos.
