[value] => Die Nutzung von Kameras in Betrieben durch den Arbeitgeber und im Besonderen die Rechtsgültigkeit der Videoüberwachung als ein Beweismittel von begangenen Rechtsverstößen durch Arbeitnehmer waren sowohl in der Rechtslehre als auch in der Rechtsprechung Gegenstand großer Debatten. Diese Debatten stellen vornehmlich auf das Gleichgewicht zwischen den Rechten der Arbeitnehmer und der Macht der Firmenleitung ab.
Voraussetzungen
Die Rechtsprechung hat festgelegt, dass bei der Nutzung von Überwachungskameras in Betrieben zwei Hauptvoraussetzungen befolgt werden müssen:
1. Verhältnismäßigkeit
Das Verwenden dieser Maßnahmen muss verhältnismäßig und geeignet sein, um ein rechtlich geschütztes Ziel zu erreichen.
2. Informationspflicht
Die Arbeitnehmer müssen über die Verwendung von Überwachungskameras unterrichtet werden.
Die neuere Rechtsprechung des Obersten Gerichtshofs führt aus, dass die Überwachung ohne vorherige Benachrichtigung unter bestimmten Umständen und Voraussetzungen rechtmäßig ist.
Zu den vorgenannten Voraussetzungen gehören die Eintragung des Videoüberwachungssystems im Allgemeinen Spanischen Datenschutzregister und die Mitteilung an die Arbeitnehmervertreter.
Die Videoüberwachung in Betriebsstätten bedarf keines expliziten Einverständnisses des Arbeitnehmers.
Die Einführung eines Videoüberwachungssystems sollte von rechtlichen Experten vorbereitet und begleitet werden, um die Erfüllung aller Voraussetzungen sowie die Rechtmäßigkeit zu garantieren.

El tema no deja de ser controvertido, por cuanto esto requiere equilibrar la balanza entre los derechos de los trabajadores (algunos considerados derechos fundamentales como el derecho al honor y a la intimidad personal) y el poder de dirección empresarial.
La jurisprudencia española ha establecido que la instalación y uso de cámaras de videovigilancia en los centros de trabajo debe cumplir con dos requisitos principales.
1. Proporcionalidad y uso apropiado
La instalación y uso de las cámaras deberá limitarse a lo estrictamente necesario para cumplir su finalidad.
2. Información al trabajador
Los tribunales considerarán que los empleados han sido debidamente informados cuando lo han sido a través de distintivos informativos claros. No obstante, la jurisprudencia también autoriza a los empresarios a usar sistemas de videovigilancia sin previo aviso cuando:
i) estos se registren en el Registro General de Protección de Datos de la Agencia Española de Proteción de Datos, y
ii) se le comunique a los representantes de los trabajadores.
Tanto en un caso como en otro, no se requerirá el consentimiento del trabajador, pues éste se considera implícito en la firma del contrato de trabajo.
Resulta pues aconsejable que los pormenores de la implantación de este tipo de sistema por parte del empresario, en uno o varios centros de trabajo, sea precedida y acompañada de un asesoramiento letrado que garantize el cumplimiento de todos los requisitos y asegure su plena validez y eficacia.
